What Is the TCPA?

The Telephone Consumer Protection Act (TCPA), 47 U.S.C. ยง 227, is a federal law that regulates how businesses may contact consumers by phone, text message, and fax. It requires businesses to obtain prior express written consent before contacting consumers through automated dialing systems (autodialers), prerecorded or artificial voice messages, or text messages sent via automated technology.

The TCPA is enforced by the Federal Communications Commission (FCC) and may also be enforced by consumers through private lawsuits. Statutory damages are $500 to $1,500 per violation, which can accumulate rapidly in class action cases.

What You Are Consenting To

When you check the consent checkbox on our loan inquiry form, you are providing express written consent: as required by the TCPA, to be contacted by the following parties:

  • Lendifi.io (operated by Apex Lead Group LLC), for follow-up on your loan inquiry, service updates, and promotional offers related to financial products
  • Lender partners: the independent licensed lenders in our network to whom your inquiry is transmitted, who may contact you regarding their loan products and services

This consent permits contact by:

  • Phone calls, including calls made through automatic telephone dialing systems (autodialers)
  • Prerecorded or artificial voice messages
  • Text (SMS and MMS) messages sent via automated technology
  • Email communications

Contact may occur at the phone number and email address you provided in the form, even if your number is listed on a federal or state Do Not Call registry.

Consent is not required to obtain any product or service. You can request a loan through Lendifi.io without agreeing to receive autodialed or prerecorded communications by not checking the consent box. However, lenders may need to contact you to process your inquiry, and declining consent may limit the lenders we can match you with.

Section 3

How We Record and Store Your Consent

Every time a consumer checks the consent checkbox and submits our form, we automatically capture and permanently store the following in our secure database:

  • Timestamp: the exact date and time (UTC) the checkbox was checked and the form was submitted
  • IP address: your internet protocol address at the time of submission, which helps establish geographic location and identity
  • User agent: your browser type and device information, confirming a human interaction
  • Consent language: a verbatim copy of the exact consent text that was displayed on the form at the time of your submission
  • Source URL: the web page where the form was submitted
  • Lead ID: a unique identifier tying your consent record to your loan inquiry record

These records are retained for a minimum of five (5) years in compliance with TCPA documentation best practices. They serve as our proof of consent in the event of any regulatory inquiry or legal dispute.

Section 4

Who May Contact You

Your consent covers contact from Lendifi.io and the specific lender partners to whom your inquiry is transmitted. We transmit your inquiry only to lenders whose eligibility criteria match your profile at the time of submission.

Each lender who receives your information operates under their own TCPA compliance program and privacy policy. Once a lender receives your information, they are independently responsible for their communications with you under their own consent records.

We do not sell your contact information to unrelated third parties or data brokers for marketing purposes outside of your loan inquiry.

Section 5

Message Frequency & Rates

Message frequency will vary depending on how many lender partners your inquiry is matched with and their individual communication practices. You may receive multiple contacts from different lenders in the days following your form submission as each lender reviews and responds to your inquiry.

Standard message and data rates may apply to text messages received from Lendifi.io or lender partners, depending on your mobile carrier plan.

Section 6

How to Opt Out

You may revoke your consent and opt out of future communications from Lendifi.io at any time using any of the following methods:

Email: Send a message to legal@lendifi.io with the subject line "Opt Out" and include your name and the phone number and email address you used on the form. We will process your request within 10 business days and add you to our internal suppression list.

Text: Reply STOP to any text message you receive from Lendifi.io.

Phone: When called, you may verbally request to be removed from our contact list.

Important limitation: Opting out of Lendifi.io communications stops us from contacting you and from transmitting your information to new lender partners. However, lenders who already received your inquiry prior to your opt-out request have their own consent records and may continue to contact you under those records. You should opt out directly with each lender to stop their communications.

We maintain an internal suppression list of opted-out consumers and check all new submissions against this list before transmitting to lenders.

Section 7

Do Not Call Registry

By providing express written consent through our form, you are consenting to receive calls and texts from Lendifi.io and lender partners even if your phone number is registered on the National Do Not Call Registry or any state Do Not Call list. Your consent supersedes your Do Not Call registration for communications related to your loan inquiry.

If you opt out of communications as described in Section 6, your number will be added to our internal Do Not Call list, which we maintain separately from and in addition to the federal registry.

Section 8

2026 Regulatory Updates

The FCC and federal courts have been actively updating TCPA regulations. Key developments affecting our operations:

  • One-to-One Consent: The FCC's one-to-one consent rule, which was vacated by the 11th Circuit Court of Appeals in February 2025, is no longer in effect. We continue to obtain clear, specific consent identifying Lendifi.io and its lender partners.
  • Revocation Rules: The FCC has delayed the broad "revocation-all" requirement (applying a single opt-out across all communications from a sender) until January 31, 2027. We are building infrastructure to comply with this requirement ahead of its effective date.
  • Consent Documentation: We treat consent documentation as a core operational requirement, not a legal checkbox. Every consent record is stored with full metadata and is audit-ready.
